- Products / Services: Activities, guided tours, local transfers, equipment hire, and related event arrangements offered directly by the Company or via third-party Suppliers.
- Client / Organiser: A natural person of legal age (at least 18 years old) or a legal entity entering into an agreement with the Company (hereinafter referred to as "You" or the "Client").
- Participants: All individuals taking part in the booked Services on whose behalf the Organiser acts.
- Supplier / Subcontractor: An independent third party (e.g., shooting range operator, licensed transport provider, private boat skipper, or venue) collaborating with the Company to deliver specific activity components.
- Contract: The legally binding agreement concluded between the Company and the Client upon payment of the required deposit.
- Initial Voucher: Electronic booking summary setting out the provisional itinerary, participant numbers, pricing, and payment schedules.
- Final Voucher: The official confirmation document issued after payment is received, detailing full meeting times, locations, and coordinator contact details.
- Force Majeure: An external, unforeseeable, and unavoidable event beyond the reasonable control of the affected party that objectively prevents contract fulfillment.
- Company / Supplier Side: Covers natural disasters, severe adverse weather rendering outdoor activities objectively hazardous or legally prohibited, armed conflict, civil unrest, sudden regulatory prohibitions, public health emergency closures, or the sudden certified medical incapacitation or unavoidable absence of specialized key personnel or licensed instructors (such as certified range safety officers, licensed tandem pilots, or certified boat skippers) whose legal qualifications are indispensable to the activity and who cannot be substituted despite all reasonable efforts.
- Strict Exclusion for the Client & Group: Force Majeure expressly excludes personal travel disruptions, flight cancellations or delays, missed transport connections, transport strikes outside the destination city, passport/visa issues, individual illnesses or injuries (including that of the Stag or Organiser), alcohol-induced incapacitation, hangover, refusal of border entry, or individual participant absence. These constitute personal travel risks assumed entirely by the group.
Article 2: General Provisions & Nature of Services
- These Terms define the principles of booking and participating in events organised by the Company.
- Participation is strictly limited to individuals aged 18 or older. The Organiser warrants that all participants meet this age requirement.
- Depending on the service booked, the Company acts either as the direct organizer or as a disclosed commercial intermediary/agent between the Client and third-party Suppliers.
- The Company sells standalone day activities, local event transfers, and entertainment services. The Company is not a travel agency and does not sell package holidays within the meaning of EU Directive 2015/2302. We do not provide airline tickets, cross-border passenger transit, or multi-day tourist accommodation packages.
Article 3: Orders, Payments, Fees & Invoices
- Booking Confirmation: Services are booked directly through the Website or via email offer. Booking requires selection of the activity, date, estimated participant count, and payment of the required deposit.
- Advance Payment (Deposit): Confirmation requires an advance deposit between 20% and 50% (up to 100% for exclusive-hire items such as private charters or high-demand venues).
- All advance payments constitute a contractual deposit (zadatek umowny).
- The parties agree to exclude the application of Article 394 of the Polish Civil Code regarding claims for double the deposit amount. In the event of contract termination or non-performance by the Company, the Company's maximum liability is strictly limited to returning the nominal amount paid by the Client.
- Settlement of the Remaining Balance & Prepayment Terms:
- Destinations Eligible for On-Site Cash Settlement (Poland, Czech Republic, Budapest): For events taking place in Poland, the Czech Republic, and Budapest (Hungary), the default and standard method for settling the remaining balance is in cash (in local currency) directly to the assigned Company Guide/Coordinator at the gathering point prior to the start of the scheduled itinerary.
- Destinations Requiring 100% Upfront Payment: For events taking place in all other destinations (including, but not limited to: the Netherlands/Amsterdam, Germany, Slovakia/Bratislava, etc.), on-site cash payment is not available. The total booking value must be paid 100% in advance online no later than 15 calendar days prior to the event date (or immediately upon booking if booked within 15 days of the event).
- Special Activities Requiring 100% Upfront Prepayment (All Cities): Regardless of the destination city, certain specific activities strictly require full (100%) upfront prepayment due to irreversible supplier reservations, venue exclusivity, or non-refundable tickets. These include, but are not limited to: shared boat cruises, dwarf hire, shared bar crawls, VIP club/table bookings, ticketed shows, and select private charters. The Client will be clearly informed of any mandatory 100% prepayment requirement prior to booking confirmation or on the Initial Voucher.
- Optional Online Balance Settlement & 4% Processing Fee: For bookings eligible for on-site cash settlement (Poland, Czech Republic, Budapest), the Client may choose the convenience of paying the remaining balance online prior to the event via secure payment gateway (Stripe, Przelewy24, or another available gateway). When the Client elects to settle the balance online rather than in cash on-site, an administrative and payment processing fee of 4% may be added to cover electronic processing and remote account management. This 4% fee does not apply to activities or destinations that are subject to mandatory 100% upfront prepayment.
- Failure to Pay & Right to Cancel: For any activities or destinations requiring prepayment (whether full 100% prepayment or balance settlement by a specified deadline), if the Client fails to settle the outstanding amount by the required date, the Company reserves the right to cancel the booking due to reasons attributable to the Client. In such circumstances, any deposit or funds already paid will be retained in full to cover committed supplier costs and administrative expenses, and no refund will be issued.
- Electronic Payments: Online transactions are handled via secure payment gateways (Stripe, Przelewy24/PayPro). In accordance with EU Directive 2015/2366 (PSD2), no unauthorized surcharge is added to standard initial credit card, debit card, or electronic bank transfer payments.
- Invoicing: The Company issues invoices in accordance with Polish tax regulations. Requests for B2B VAT invoices must be submitted prior to payment and must include the company's full legal name and VAT/Tax ID.
Article 4: Modifications and Cancellation Policy
- Unpaid Enquiries: Preliminary unpaid bookings carry no legal obligation and may be altered or cancelled without charge.
- Exclusion of Statutory 14-Day Consumer Withdrawal: Pursuant to Article 16 of Directive 2011/83/EU and Article 38(12) of the Polish Consumer Rights Act, the statutory 14-day right of withdrawal for distance contracts does not apply to leisure, catering, transport, or entertainment services tied to a specific date or period of performance. Once confirmed, cancellations are subject strictly to the terms below.
- Changes to Participant Numbers:
- 7 or More Days Before the Event: The Organiser may reduce group numbers in writing (email). Amounts paid toward withdrawing participants will be credited toward the remaining balance, provided the group remains above the minimum group size required for that activity.
- Fewer Than 7 Days Before the Event: Monies paid for non-attending participants cannot be credited or refunded where supplier costs, lane reservations, transport hire, or staff fees have already been irrevocably committed.
- Full Cancellation by the Client:
- More than 60 calendar days prior: The deposit is retained, and the Client automatically receives a Credit Voucher equal to 100% of the deposit, valid for 12 months for any Company services.
- Between 60 and 10 business days prior: The deposit is forfeited in full to cover administrative and committed supplier reservation costs. No voucher is issued and no additional payment is required.
- Fewer than 10 business days prior: The Client is obligated to settle 100% of the total booking value. Any outstanding balance must be paid within 7 calendar days upon invoice receipt.
Article 5: Operational Rules, Delays & Company Cancellations
- Unavoidable Cancellation by the Company: If an activity cannot be conducted due to Force Majeure, extreme hazardous weather, or the sudden certified medical incapacitation of irreplaceable specialized key personnel (as defined in Article 1), the Company will promptly notify the Client and provide:
- An alternative activity of comparable standard, OR
- An alternative time slot during the group's stay, OR
- A full (100%) nominal refund of all monies paid for the affected service component.
- Pre-Event Coordination (24-Hour Window): Active communication is required. The Organiser must ensure contact details (mobile phone and WhatsApp) provided at booking are active and must confirm meeting logistics when contacted by the local coordinator in the 24 hours prior to the event.
- Punctuality & No-Show:
- Groups must arrive at the designated meeting location 10 minutes prior to scheduled start times.
- In the event of unexpected travel delay, the Organiser must notify the coordinator immediately. A maximum grace period of 30 minutes is permitted.
- If the group fails to arrive within 30 minutes of the scheduled time without contact, or if the group is unreachable across phone and messaging channels, the booking will be registered as a No-Show. Venues and staff are released, and all payments are strictly non-refundable.
Article 6: Participant Safety, Code of Conduct & Insurance
- Sobriety & Conduct: For activities involving motorized vehicles, shooting ranges, watercraft, and extreme sports, Suppliers operate a strict zero-tolerance policy regarding alcohol and narcotics. Instructors and coordinators reserve the right to exclude any participant who is visibly intoxicated or non-compliant with safety guidelines, with no right to a refund.
- Liability for Damages & Organiser's Direct Guarantee: The Client (the individual or entity concluding the contract and providing payment details) warrants the conduct of all Participants in the group. Pursuant to the applicable provisions of the Polish Civil Code (including Art. 391 and Art. 474 KC), the Client assumes full, unconditional, and joint and several liability (odpowiedzialność solidarna) for any intentional, reckless, or negligent damage caused by any Participant to equipment, vehicles, venues, personnel, or third-party property during the event.
- Assessment: Damage will be assessed on-site with photographic evidence, written incident notes, or supplier estimates whenever feasible.
- Billing Details & Formal Service: The Client expressly confirms and agrees that the legal name, billing address, and email address provided during the checkout and payment card authorization process constitute their verified, legally binding address for service of formal claims, debit notes, and damage invoices. Delivery of a formal claim or invoice to said email and/or billing address shall be deemed legally valid and effective service.
- Settlement: Costs must be settled immediately on-site or within 7 calendar days of the issuance of the invoice or debit note to the paying party. The Client remains directly responsible for settling the full amount regardless of whether they subsequently recover these costs internally from the individual perpetrator.
- Personal Insurance: Standard booking fees do not include individual medical or accident insurance (NNW). Participants take part at their own risk. All Participants are advised to obtain comprehensive travel and medical insurance that covers high-risk leisure activities and extreme sports.
Article 7: Complaints Procedure
- Any complaints regarding the quality or execution of the Services must be submitted within 30 calendar days from the date the event concluded. Complaints submitted after this period cannot be investigated with subcontractors.
- Complaints must be submitted in writing via email to hello@staghero.com or by registered post to the Company's registered address.
- A valid complaint must state: the booking reference number, event date, Client's contact details, and a clear factual description of the issue accompanied by supporting evidence (e.g., photos or timestamps).
- In compliance with statutory consumer protection regulations, the Company will review and issue a formal written response within 14 calendar days of receiving a complete complaint. Approved refunds will be credited to the original payment source.
